Terms and Conditions of Sale

Article 1 - Purpose and scope of application

These general terms and conditions of sale (hereinafter referred to as the " GTC’s ") apply to the website www.le19m.com (hereinafter referred to as the " Site "), operated by the company le19M, Société par Actions Simplifiée with a capital of 40,000, having its registered office at 2 Place Skanderbeg - 75019 Paris, France, registered under the number RCS Paris 892 877 127 (hereinafter referred to as "le19M", accessible by e-mail at info@le19m.fr), which offers for sale at a global price one or more tickets for visits and/or guided tours, workshops and/or conferences and/or events and/or any other activity (hereinafter referred to as the "Ticket(s)") to la Galerie du 19M.

The purchase of Tickets is reserved exclusively for end Purchasers acting for strictly personal purposes and not for any commercial activity, thus excluding any resellers or any intermediaries acting on behalf of resellers (hereinafter referred to as the " Purchaser ").

The Purchaser declares that he/she has the legal capacity to purchase Tickets on the Site and to be bound by the terms and conditions of these GTCs. The purchaser declares that he/she is acting as an end Purchaser and that he/she does not intend to resell the Ticket(s).

These GTC are brought to the attention of the Purchaser prior to the validation of his/her order. By placing an order for Tickets on the Site, the Purchaser accepts, without limitation or reservation, all the provisions of the GTC that appear on the Site at the time of the order, by ticking the box provided for this purpose. The GTC are available for consultation throughout the sales process and at the time of purchase confirmation. The GTC may be modified by le19M at any time, but the GTC in force on the Site at the time the Purchaser places his/her order shall be applicable, subject to the conditions defined below.

These GTC may be saved and/or printed and are accessible on all pages of the Site. They are available in English and French.


Article 2 - Characteristics of the Tickets sold

2.1 The Tickets offered on the Site allow the Purchaser to benefit from the following services, according to his/her choice :

  • Admission, with or without a guide, to la Galerie du 19M and to the exhibition(s) presented there, on a given date and at a given time;

  • Admission to workshops allowing access to workshops organised by la Galerie du 19M on a specific date and at a specific time;

  • Admission to conferences organised by la Galerie du 19M on a specific date and at a specific time;

  • More generally, any other event or activity organised by la Galerie du 19M on a given date and at a given time.

Tickets are valid only on the date and at the time indicated. Any exit from la Galerie du 19M is final.

2.2 Ticket purchases are made in real time. The Site will inform the Purchaser of the availability of the desired Tickets at the time the order is placed. 

2.3 The following information appears on Tickets issued by le19M :

  • le19M name and/or logo;

  • Name of the service;

  • Date and time of the service;

  • Full name of the Purchaser;

  • Type of fee and amount in euros net of tax;

  • Application of a promotional code;

  • Date of Ticket purchase;

  • Bar code and QR code allowing its validation at the entrance of la Galerie du 19M;

  • Ticket number issued by the computer system;

  • Access way tola Galerie du 19M.


2.4 In respect of fee type, each Ticket indicates which of the following fee categories applies to it :

  • Full price – Adult

  • Full price – Child

  • Guest price, activated by a personal code issued by le19M.

2.5 Tickets will be delivered immediately in electronic format to the email address provided in accordance with Section 3 below.


Article 3 - Order process

3.1 The Purchaser may browse the Site without placing an order.

3.2 The languages available for purchasing Tickets on the Site are English and French.

3.3 If the Purchaser wishes to purchase Tickets on the Site, the Purchaser shall proceed as follows :
1. Select the service(s) of his/her choice;
2. Select the date and time of the desired visit using the calendar that displays the available slots. If a slot is no longer available, it will be displayed in red and marked as unavailable;
3. Enter a promotional code if required;
4. Select the number of Tickets to purchase, within the limits of the quantities offered on the Site, and then click "Add to Basket". The selected service(s) will be stored in the basket for 19 minutes;
5. To confirm the order, the Purchaser must click on "Buy Now";
6. In order to place the order, the Purchaser may choose to :
i. create an account on the Site by providing his/her contact details (name, first name and email address to which the Purchaser will receive an email to activate his/her  account);
ii. login if an account has already been created; or
iii. continue as a guest, in which case the Purchaser must provide an email address.

The Purchaser is responsible for the accuracy and updating of the information provided. 19M cannot be held responsible if the information provided is incomplete or contains errors and if, as a result, 19M is unable to execute all or part of the order under the conditions provided.

7. A summary of the order will be displayed. If the order matches, the Purchaser will be asked to confirm the order. If not, the Purchaser is invited to return to the selection of Tickets;
8. Before finalising the order, the Purchaser is asked to accept the GTC (accessible via a link) by ticking the box provided for this purpose and clicking on "Proceed to payment";
9. The Purchaser must then select the payment method among those proposed by the Site (as indicated in article 4.2 of these GTC),
10. The Purchaser must then click on "Pay" and make a single payment in full for the amount of his/her order; the sales contract shall be deemed concluded when the Purchaser's bank card is debited, even if the Purchaser's bank card is debited before the Ticket(s) are sent;
11. If the payment is accepted, a confirmation of the order is displayed and the Purchaser receives a summary email to the email address provided when creating his/her account or placing the order, together with his/her Ticket(s) in PDF format.

3.4 As long as the payment has not been registered or initiated, the Purchaser has the possibility of modifying or deleting all or part of the contents of his/her shopping basket.

3.5 Proof of order
In general, it is expected that emails will be used as evidence between the Purchaser and 19M, in particular as to the nature and date of the order.
It is recommended that the Purchaser keeps a copy (in electronic and/or paper form) of the elements relating to his/her order.


Article 4 - Rates and payment conditions

4.1  Rates
The price of the Tickets is indicated in Euros and includes all taxes indicated on the Site.
le19M reserves the right to change its prices at any time and without notice. However, the Tickets will be invoiced to the Purchaser on the basis of the prices in force on the Site at the time the order is placed and le19M will not be able to modify them once the order has been validated by payment.

The services and prices indicated on the Site are subject to availability.


4.2 Terms and conditions of payment
All orders, regardless of their origin, are payable in Euros.
The total amount payable by the Purchaser will be displayed on the Site prior to the final validation of the order.

The payment of the order is made exclusively on the Site by Visa or Mastercard bank card via the secure platform of the payment provider Adyen. In order to proceed with the payment, the Purchaser must fill in some credit card information, including the name of the cardholder, the credit card number, its expiration date and its cryptogram number. The information provided by the Purchaser when placing an order is encrypted and sent directly to Adyen. It is not stored by le19M and is not accessible to it. As Adyen is a technical service provider, it does not deal with disputes relating to orders, which are dealt with directly by le19M.

The payment is considered valid once the payment agreement has been confirmed by the issuing organisation. If the latter refuses, the order will be automatically rejected and le19M will be released from any obligation or responsibility towards the Purchaser.


Article 5 - Terms and Conditions of Use of Tickets

5.1 Tickets may be used after they have been printed from the order confirmation email or downloaded to a mobile phone. Partially or poorly printed, damaged or illegible Tickets are not valid. It is strictly forbidden to duplicate or counterfeit a Ticket in any way. 

5.2 The first person to present the Ticket will be presumed to be the legitimate holder. Any subsequent person presenting a copy of the Ticket will be denied access to the Service. 

5.3 Access to the service is subject to verification of the validity of the Ticket. The Ticket is provided with a barcode and will be checked and recorded by the control officers using barcode readers. The Purchaser must retain the Ticket for the duration of the Service. 

5.4 le19M declines all responsibility in the event of loss, theft or use of copies, including on the premises of la Galerie du 19M.


Article 6 - Conditions of access to the Galerie du 19M

6.1 Before entering la Galerie du 19M, the Purchaser is invited to read la Galerie du 19M's rules for visitors and must in any case comply with the rules in force on la Galerie du 19M's premises, as set out in la Galerie du 19M's rules for visitors, which can be accessed at https://www.le19m.com/reglement-de-visite

6.2 The Purchaser acknowledges and accepts that in the context of the Covid-19 virus health crisis, or more generally in the context of any such crisis, sanitary measures may be imposed in and around la Galerie du 19M and undertakes to comply with them without reservation. Failure to do so may result in the Purchaser being denied access to or ejected from the premises of la Galerie du 19M, without any refund being due.

6.3 All exits from la Galerie du 19M are final.


Article 7 - Personal data

For more information on how the Buyer's personal data is processed by 19M in the context of an order, the Customer may refer to the "Privacy Policy" of 19M.


Article 8 - Intellectual Property Rights

The Site and all its components, in particular programmes, data, texts, images, sounds, drawings, graphics, etc., are the property of 19M or are the subject of an authorisation granted to it. Any copy, reproduction, representation, adaptation, distribution, in whole or in part, of the Site, by any means and on any medium, is subject to the prior written authorisation of le19M.

It is forbidden to create a hypertext link to the Site from a third party site without the prior written authorisation of le19M.

le19M and its affiliates are the exclusive owners of the rights to their trademarks, logos, creations, models, advertising materials, products, representations of their products, patents, trade secrets, know-how, etc. and, more generally, of all intellectual property rights relating to their creations and distinctive signs (the "Protected Elements"). The Purchaser is expressly prohibited from using the Protected Elements in any country, for any reason whatsoever (including as a commercial reference) and in any manner whatsoever, without the prior written consent of le19M.

Article 9 - Right of withdrawal, refund and exchange

9.1 In accordance with Article L221-28 12° of the French Consumer Code , Tickets are not subject to a right of withdrawal.

9.2 Tickets are non-refundable, non-exchangeable and non-transferable.

9.3 Tickets are non-exchangeable and non-refundable, except in the case of cancellation or alteration of a service ordered by the Purchaser due to le19M.

9.4 In the event of cancellation or modification of the service ordered by the Purchaser due to le19M, le19M will reimburse the full price of the Ticket to the Purchaser at the latest within fourteen days following the date of cancellation or modification of the service, using the same means of payment as the one used by the Purchaser for the initial transaction, unless the Purchaser expressly agrees to use another means of payment  


Article 10 - Liability

10.1 In no event shall le19M be liable for any failure to provide, or failure to provide properly, the services to which the Tickets entitle the Purchaser due to the Purchaser's fault, or due to the unforeseeable and irresistible act of a third party, or due to a case of force majeure as defined in article 11 of these GTC.

10.2 Except in the event of a malfunction of the Site for which it is responsible, le19M shall not be held liable for any anomaly that may occur during the ordering, processing, downloading or printing of the Ticket, whether caused by the Purchaser or by an unforeseeable and insurmountable act of a third party not involved in the service, or by computer or server failures, or by the blocking of telecommunications, including networks, and in particular the Internet.

10.3 le19M cannot be held responsible for the use of the Tickets purchased, and the Purchaser is solely responsible for the use of the Tickets by him/herself and any accompanying person(s). 


Article 11 - Force majeure

le19M shall not be liable for the total or partial non-fulfilment of its obligations arising from an order and these GTC if such non-fulfilment is caused by an event constituting force majeure under the conditions defined by the Civil Code and the case law of the Court of Cassation.


Article 12 - Complaints

All claims must be made in writing to the email address billetterie@le19m.fr or via le19M Site (under the "Contact Us" section).


Article 13 - Non-waiver and partial disability

13.1 No waiver
The fact that le19M does not demand the execution of a provision of these Terms and Conditions at a given time cannot be interpreted as a waiver of the right to invoke the total or partial non-execution of said provision at a later time.

13.2 Partial Disability
In the event that one or more of the provisions of these GTC are held to be invalid or declared as such pursuant to any law, regulation or final decision of a competent court, the remaining provisions of these GTC shall continue to apply under the same terms and conditions.


Article 14 - Law of application / Dispute settlement

The present GTC and all orders placed on the Site pursuant to the present GTC are governed by French law.

In the event of a complaint or dispute relating to the Site, these GTC and/or an order, and before any request for mediation, the Purchaser must first contact 19M (in accordance with the conditions set out in article 12) to inform le19M of his/her complaint or dispute and to attempt to reach an amicable settlement with le19M.

In case of complaint not amicably resolved by le19M within a period of [one (1) month], the Purchaser may contact the online mediation service of Centre de Médiation et d'Arbitrage de Paris (hereinafter "CMAP") accessible at the URL address: http://cmap.fr/ or at the postal address: CMAP (Service de Médiation de la Consommation), 39 avenue Franklin Roosevelt - 75008 Paris.  

In order for the Purchaser to be able to refer the dispute to the CMAP, the request must contain: the Purchaser's postal address, telephone number and e-mail address, the full name and address of le19M, a brief description of the facts and evidence of the steps taken by the Purchaser to resolve the dispute amicably.

Article L152-2 of the Consumer Code: A dispute cannot be examined by the consumer conciliator if :

1. The consumer cannot justify having previously tried to settle the dispute directly with the trader by means of a written complaint in accordance with the procedures laid down in the contract, if any;
2. The claim is manifestly unfounded or abusive;
3. The dispute has been or is being examined by another conciliator or by a court;
4. The consumer has made his request to the mediator more than one year after his/her written complaint to the professional;
5. The dispute does not fall within the professional's sphere of competence. The consumer shall be informed by the mediator of the rejection of his/her request for mediation within three weeks of receipt of the file.

Notwithstanding the foregoing, if an amicable settlement cannot be reached (including following the mediation process described above), or if the Purchaser wishes to bring a claim or dispute directly before a court without following an amicable settlement process, the French courts shall have jurisdiction to hear any dispute relating to the Site and these GTC.

Appendix 1 - Withdrawal Form
